OFFICIAL RULES TREE TOP “BRANCH OUT OF THE ORDINARY” SWEEPSTAKES 3/25/07- 4/30/07 ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. A PURCHASE WILL NOT IMPROVE YOUR ODDS OF WINNING. Open to individual, legal residents of TX, CO, CA, MO, KS, WI, MN, MT, WY, NM, ID, OR, NV, OK, UT, LA, AZ and WA who are 18 years of age and older at time of entry. Employees of Tree Top, Inc. (“Sponsor”), Advantage Sales & Marketing LLC d/b/a Integrated Marketing Services, and each of their respective parents, successors and assigns, subsidiaries and affiliates; employees of advertising, promotion and public relations agencies involved in any way with this Sweepstakes; and members of the immediate family (spouse, parents, siblings and children and their spouses) or persons living within the same household of any of such individuals are not eligible to participate or win a prize. HOW TO ENTER: Beginning 12:00:01 AM (EDT) on 3/25/07 through 11:59:59 PM (EDT) on 4/30/07, visit www.treetop.com and complete the official entry form (an “On-line Entry”) OR to enter by mail, complete official entry form or hand print your name, address, city, state, zip code, date of birth and daytime phone number on a 3” x 5” piece of paper and mail your entry in an envelope (no larger than #10) with postage affixed to: Tree Top "Branch Out of the Ordinary" Sweepstakes, Dept. 4722, P.O. Box 5006, Stacy, MN 55078-5006 (a “Mail-in Entry”). LIMIT: one (1) entry per person, household and/or email address by all methods of entry combined. No mechanically reproduced entries will be accepted. Automated On-line Entries are prohibited. On-line Entries must be received by 11:59:59 (EDT) on 4/30/07. All Mail-in Entries must be postmarked by 4/30/07 and received by 5/5/07. Sponsor not responsible for late, lost, misdirected, damaged, incomplete, illegible or postage-due entries/mail. Sponsor also not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error, including computer system, phone line, hardware, software or program malfunctions, or other errors, failures or delays in computer transmissions or network connections, which may occur in the processing of the submissions. All entries become the property of Sponsor and none will be acknowledged or returned. Should multiple users of the same e-mail account enter the Sweepstakes online and a dispute thereafter arise regarding the identity of the entrant, the authorized account subscriber of said e-mail account at the time of entry will be considered the entrant. "Authorized account subscriber" is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. PRIZES: On or about 5/16/07, a random drawing will be conducted by an independent judging organization, from all eligible entries received, to award One (1) Grand Prize: $10,000 toward a tree house. Prize will be awarded in the form of a $10,000 check payable in the name of the winner. Any cost above the $10,000 will be the sole responsibility of the winner. Three (3) First Prizes: a $1,000 Amazon.com® gift certificate. Ten (10) Second Prizes: a $100 Amazon.com gift certificate. Gift card/certificate use subject to the terms and conditions set by respective gift card/certificate provider. Total value of all prizes: $14,000. Odds of winning depend on total number of eligible entries received. Limit: one (1) prize per person/household. All prizes will be awarded provided a sufficient number of eligible entries are received. GENERAL CONDITIONS: No substitution or transfer of prize permitted. All federal, state and local taxes on prize are the sole responsibility of the winner. Prize winners will be notified by express mail and/or telephone and will be required to sign an Affidavit of eligibility, liability release and (where lawful) a publicity release. Noncompliance by date specified on winner notification letter or return of prize or prize notification as undeliverable will result in disqualification. Unclaimed prizes may not be awarded. Acceptance of prize constitutes winner’s agreement and permission for Sponsor and their agencies to use winner’s name/likeness for advertising and trade purposes in any and all media without further notice or compensation, unless prohibited by law. By participating in and/or accepting prize Sweepstakes entrants agree to: (a) be bound by these official rules and the decisions of the Sponsor and judges, which shall be final and binding in all respects; and (b) to release and forever discharge and covenant not to sue Sponsor, Advantage Sales & Marketing LLC d/b/a Integrated Marketing Services, and their respective parent companies, affiliates, subsidiaries, distributors, agents and promotion and advertising agencies, and the employees, directors and officers of each of the foregoing entities, from any and all claims, demands, damages, losses and liabilities, of any nature whatsoever, which they may now or hereafter assert, including but not limited to, claims for injury, death, damages, or illness arising out of or relating to or claimed to be arising out of or relating to Sweepstakes entry, prize acceptance, or use or misuse of the prize or any product or prize certificate awarded including, without limitation, personal injury, death and property damage. Sponsor and its agents are not responsible for any printing or other errors in Sweepstakes related material. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, the Sponsor may modify, terminate, or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules or, at its sole discretion, cancel or terminate the on-line portion of the Sweepstakes, in which case, Sponsor will award all prizes in a random drawing from eligible non-suspect On-line Entries received prior to the event requiring such action and all Mail-in Entries. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. This Sweepstakes will be governed by the laws of the United States and by entering you consent to jurisdiction and venue in the courts of Washington State.
